These Terms of Use ("Terms") constitute a legally binding agreement between you and Aesthetic Way LLC ("Aesthetic Way", "we", "us", or "our") governing your access to and use of https://aestheticway.ae and our mobile application. By accessing or using our services, you agree to be bound by these Terms.
تشكّل شروط الاستخدام هذه ("الشروط") اتفاقية ملزمة قانوناً بينك وبين شركة إستيتك واي ذ.م.م ("إستيتك واي" أو "نحن") وتحكم وصولك إلى واستخدامك لموقعنا الإلكتروني https://aestheticway.ae وتطبيق الهاتف المحمول. بدخولك للمنصة أو استخدام خدماتها، فإنك توافق على الالتزام بهذه الشروط.
2. Nature of Platform & No Medical Services 2. طبيعة المنصة وعدم تقديم خدمات طبية
Aesthetic Way is solely a digital discovery and connection platform. We provide a technology venue allowing users to discover independent aesthetic clinics, view treatments, browse offers, and transmit booking/consultation requests.
إستيتك واي هي منصة تواصل واستكشاف رقمية فقط. نحن نوفر واجهة تقنية تمكّن المستخدمين من اكتشاف العيادات التجميلية المستقلة، واستعراض العلاجات والعروض، وتقديم طلبات الحجز والاستشارة.
IMPORTANT MEDICAL DISCLAIMER: Aesthetic Way is not a healthcare facility, medical clinic, or medical practitioner. We do not provide medical diagnosis, treatment, clinical advice, or healthcare outcomes. No content on the platform should be construed as medical advice. Any consultation, medical assessment, or aesthetic procedure is entered into directly and exclusively between you and the respective healthcare provider.
إخلاء مسؤولية طبي هام: إستيتك واي ليست منشأة صحية أو عيادة طبية أو ممارساً صحياً. نحن لا نقدم أي تشخيص طبي، أو علاج، أو نصيحة طبية، أو ضمانات لنتائج علاجية. ولا يُعتبر أي محتوى معروض على المنصة بديلاً عن المشورة الطبية المتخصصة. إن أي استشارة، أو تقييم سريري، أو إجراء تجميلي يتم حصرياً ومباشرة بينك وبين المنشأة الصحية المعنية.
3. Clinic & Practitioner Responsibility 3. مسؤولية العيادات والممارسين الطبيين
Participating clinics and medical practitioners are independent third-party entities operating under their own health authority licenses (e.g., DHA, DOH, MOHAP). Each clinic is solely responsible for:
تعمل العيادات والممارسون الطبيون كجهات مستقلة بموجب تراخيصها الصادرة عن الجهات الصحية المختصة في دولة الإمارات (مثل هيئة الصحة بدبي، دائرة الصحة بأبوظبي، وزارة الصحة ووقاية المجتمع). وتتحمل كل عيادة وحدها المسؤولية الكاملة عن:
- Maintaining valid licenses, professional credentials, and health authority approvals in the UAE. الحصول على وتجديد كافة التراخيص والاعتمادات المهنية الصادرة عن الجهات الصحية في الإمارات.
- The accuracy of services, prices, offers, and practitioner descriptions they provide. صحة ودقة أسعار الخدمات، والعروض، وتوصيف الممارسين والكادر الطبي المعروض.
- All professional medical care, patient consent, and treatment delivery. كافة جوانب الرعاية الطبية، وأخذ موافقة المريض المستنيرة، وإجراء العلاجات التجميلية.
4. User Accounts & Acceptable Use 4. حسابات المستخدمين وشروط الاستخدام المقبول
When creating an account, you agree to provide true, accurate, and current information. You are responsible for safeguarding your credentials and verifying one-time passwords (OTP). You agree not to:
عند إنشاء حساب، فإنك تقر بتقديم بيانات صحيحة ودقيقة وحديثة. وتتحمل مسؤولية الحفاظ على سرية حسابك ورموز التحقق (OTP). وتتعهد بعدم:
- Submitting fraudulent, automated, or abusive consultation requests to clinics. إرسال طلبات حجز أو استشارة وهمية أو مؤتمتة أو مسيئة للعيادات.
- Attempting to reverse-engineer, probe, or breach the security of the platform or APIs. محاولة اختراق المنصة أو استخراج البيانات أو فحص ثغرات الواجهات البرمجية (APIs).
- Violating any applicable federal or local laws of the United Arab Emirates. مخالفة أي قوانين أو تشريعات اتحادية أو محلية سارية في دولة الإمارات العربية المتحدة.
5. Limitation of Liability 5. حدود المسؤولية
To the maximum extent permitted by applicable UAE laws, Aesthetic Way LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the platform, interactions with clinics, treatment outcomes, or any inability to access the services.
إلى أقصى حد تجيزه القوانين السارية في دولة الإمارات العربية المتحدة، لا تتحمل شركة إستيتك واي ذ.م.م أي مسؤولية عن أي أضرار مباشرة أو غير مباشرة أو تبعية تنشأ عن استخدامك للمنصة، أو تعاملك مع أي عيادة، أو نتائج الإجراءات والعلاجات، أو أي انقطاع في الخدمة.
6. Termination 6. إنهاء الاستخدام
We reserve the right to suspend or terminate your account and access to the platform at our sole discretion, without prior notice, if you breach these Terms or engage in conduct harmful to users or clinics.
نحتفظ بالحق في تعليق أو إنهاء حسابك وحقك في استخدام المنصة وفقاً لتقديرنا المنفرد، ودون إشعار مسبق، في حال مخالفة هذه الشروط أو ارتكاب أي تصرف يضر بالمستخدمين أو الشركاء.
7. Governing Law & Jurisdiction 7. القانون الواجب التطبيق والاختصاص القضائي
These Terms shall be governed by and construed in accordance with the federal laws of the United Arab Emirates and the local laws applicable in the Emirate of Sharjah. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the United Arab Emirates.
تخضع هذه الشروط وتُفسر وفقاً للقوانين الاتحادية لدولة الإمارات العربية المتحدة والتشريعات المحلية المعمول بها في إمارة الشارقة. وتخضع أي نزاعات تنشأ عن هذه الشروط للاختصاص القضائي الحصري للمحاكم المختصة في دولة الإمارات العربية المتحدة.
